Everything You Always Wanted to Know About Non-Competes in Georgia (But Were Afraid to Ask): FTC’s Guidance and its Impact on Georgia Companies

The FTC’s recent proposed rule barring non-compete agreements will require companies to think critically and be proactive in their approach to protecting competitive information. The ACC Georgia Chapter welcomes Polsinelli whose attorneys, Leslie Spasser, Amanda Norcross, Joe Sharp, and Burton Peebles will present “Everything You Always Wanted to Know About Non-Competes in Georgia (But Were Afraid to Ask): FTC’s Guidance and its Impact on Georgia Companies”. This panel will provide insight into the FTC’s guidance, address the intersection of the FTC’s guidance with Georgia law and explore alternative means to protect valuable company assets. Looking at the issue from an employment law, transactional and litigation perspective, the panel will discuss the potential impact of the proposed bar on non-competes and its impact on employment contracts, corporate transactions, trade secret protection and litigation trends in Georgia.

Leslie F. Spasser partners with her clients to provide strategic and tactical guidance on complex business transactions involving technology and related matters. Leveraging eight years of in-house experience as well as her work as outside counsel, Leslie works closely with her clients’ business and legal teams to understand and help them achieve their key objectives. Leslie’s extensive work supporting technology organizations has positioned her to handle cutting-edge transactions involving artificial intelligence, edge computing, new iterations of cloud-based services and adaptive software.

Amanda Norcross is a trusted advisor to companies entering into complex business transactions and provides clients with immediate and long-term solutions to various matters. She focuses her practice on mergers and acquisitions for private companies across a diverse array of industries.

Joe Sharp consistently strives to achieve optimal results through an acute understanding of client objectives, thorough preparation and the ability to simplify and present complex matters in a straight forward persuasive manner. Joe has significant experience litigating cases in a variety of areas including: Intellectual Property; Real Estate; Financial Services; Entertainment; Restrictive Covenants; and Employment. Joe has represented clients in numerous federal and state courts, including courts located in Georgia, South Carolina, Florida, Alabama, Texas, Mississippi, Pennsylvania, Illinois, Tennessee, and Delaware.

Burton Peebles advises clients on a wide variety of workplace issues, including employee leaves of absence, disability accommodations, religious accommodations, and conducting workplace investigations. He strives to ensure employers meet their business goals, including compliance with the law, avoiding litigation, and appropriately positioning themselves to defend litigation when necessary. He also has extensive experience navigating reductions in force, drafting, and negotiating severance agreements, advising clients facing employment litigation in both state and federal court, and drafting customized employee handbooks for clients in all 50 states and the District of Columbia. Burton also frequently advises clients seeking to prepare and enforce restrictive covenants in jurisdictions nationwide, where permitted.

Attendance is limited to ACC members and their invited in-house counsel guests, as well as prospective ACC members. ACC membership is open to attorneys who practice law as in-house counsel employees of organizations and who do not hold themselves out to the public for the practice of law.

Thanks to Polsinelli, the CLE lunch program is complimentary for the first 130 ACC members who register on-line. Thereafter, the fee for current ACC members is $25, and, in all circumstances, $35 for non-members, including prospective members. A CLE credit of one (1) hour is being applied for, and if approved, will be submitted to the Georgia State Bar for attendees licensed to practice in Georgia.
